TERMS OF SERVICE AGREEMENT

Welcome to Chris Christo Skin Care & Makeup the site for skin care and makeup.  Please read the following Terms of Service Agreement before making your purchase.

1. Acceptance of Terms

By accepting Chris Christo Skin Care and Makeup’s Terms of Service (TOS) including but not limited to payment or authorization of payment or sale, you agree to be bound by the following terms and conditions.  You also agree that your electronic acceptance of these TOS shall have the same force and effect as if you had agreed to these TOS in writing.

Chris Christo Skin Care and Makeup provides its service to you subject to the following TOS, which may be updated from time to time without notice to you.   By using Chris Christo Skin Care and Makeup’s services, you also agree to the most current version of the TOS.  Failure to comply with the TOS may result in denial of services.

2. Description of Service

Chris Christo Skin Care and Makeup provides skin care and makeup products for sale.  You understand that the services may include certain communications from Chris Christo Skin Care and Makeup such as advertisements, notices, and service announcements.

3. Privacy Policy

Personal data and certain other information about you are subject to our Privacy Policy.  Your privacy is important to us.  To better protect your privacy we provide this notice explaining our online information practices.   Please read the Privacy Notice.

4. Internet Use

Recognizing the global nature of the Internet, you agree not to violate the rights of any party and to comply with all local, state, national, and international rules and laws regarding online conduct.  You agree not to abuse, transmit, or distribute any viruses, corrupt data, files or programs which interrupt, destroy, limit the functionality of, or cause damage to any computer software or hardware.

5. Credit Card Disputes
In the event of a credit card dispute, you must contact us by email and allow 14 business days for a response. 

6. Termination
Chris Christo Skin Care and Makeup, at its sole discretion and with or without notice, may terminate its provision of service if we believe you have violated the TOS.  You agree that Chris Christo Skin Care and Makeup shall not be liable to you for any termination of services.  Any misuse of this site regarding orders, communication, or other inappropriate or improper contact may result in the termination of your account.  You agree not to use this website and/or any product associated with it in any unlawful, libelous, fraudulent, indecent, abusive, negligent, tortuous, defamatory, slanderous, vulgar, obscene, vulgar, invasive of another’s privacy, hateful, embarrassing, harmful, threatening, or racially, ethnically or otherwise objectionable to any other person or entity as determined by in its sold discretion. 

7. Proprietary Rights

You acknowledge and agree that Chris Christo Skin Care and Makeup’s website may contain proprietary and confidential information that is protected by intellectual and proprietary rights laws.  You agree not to reproduce, duplicate, copy, or exploit any portion of, or access to Chris Christo Skin Care and Makeup’s website or service.

8. Disclaimer of Warranties
You understand and agree that any material downloaded or otherwise obtained through the use of Chris Christo Skin Care and Makeup’s services is done at your own risk and that you will be solely responsible for any damages to your computer system or loss of data or other liability that results from the download of such material.

9. Limitation of Liability

All products purchased on this website should be used as directed.  Chris Christo Skin Care and Makeup is not responsible for any manipulation or improper use of any product in any way.  The information on this website is not meant to serve as a substitute for professional medical advice.  Questions regarding the use of any of the products offered in connection with prescription drugs or skin care you may be using by prescription should be referred to your physician.  It is our intention to help you make informed decisions regarding your purchase, but not give or suggest any medical advice or serve as a medical resource.

10. Indemnification

You agree to hold harmless Chris Christo Skin Care and Makeup, its directors, officers, employees and agents from and against all claims and expenses, including attorney’s fees that may arise or result from the use of any product in an improper manner, the manipulation or addition to or of any ingredients, the use of the product in any way other than its stated use, or violation of the TOS.

11. Severability

In the event that any provision hereof is found invalid or unenforceable pursuant to judicial decree or decision, the remainder of the TOS shall remain valid and enforceable according to its terms.

12. Jurisdiction

The TOS agreement shall be governed by the laws of the State of California.  All legal proceedings are to be submitted exclusively to the jurisdiction of the courts in the State of California, County of Marin.  You agree to binding arbitration if requested by Chris Christo Skin Care and Makeup.

13. Governance

Chris Christo Skin Care and Makeup may investigate any reported violations of this agreement, its policies or any other complaints and take any action it deems appropriate to protect its employees, systems, facilities, and clients.

14. Pricing

Prices are subject to change without notice.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Products or the TOS must be filed within six (6) months after such claim or cause of action arose or be forever barred.  The section titles in the TOS are for convenience only and have no legal or contractual effect.
